Packaging & merch rules for nicotine brands

Regulations for nicotine products differentiate between types of packaging.

Primary packaging – the packaging that directly contains the product, such as a snus can or tin – is subject to the strictest rules. This includes mandatory health warnings, standardized warning text, correct placement, and other product information, all of which must comply with legal guidelines.

Secondary packaging, such as cartons, sleeves, or multipacks, can also fall under regulations if sold together with the product in stores. In these cases, the outer packaging must not circumvent the rules – for example, by hiding warnings or acting as an alternative visual representation of the product.

Gift or promotional packaging is assessed based on its use. If sold with the product, the same principles generally apply. Empty gift bags or separate tote bags typically do not fall under the same requirements.

Merchandise featuring a nicotine brand’s logo can, in some cases, be considered indirect marketing. Therefore, such products must be designed and distributed in compliance with existing regulations for advertising and marketing of nicotine products.

How nicotine brands can build identity through packaging and merch

Operating within strict regulations doesn’t mean opportunities disappear – but adaptation is key. When marketing is heavily restricted, it becomes even more important to work strategically with everything surrounding the brand. In recent years, several international nicotine brands have increasingly focused on merchandise, community products, and lifestyle-inspired collaborations.

Within legal boundaries, there is still room to develop:

Brand equity tied to lifestyle, not just the product

Rather than focusing solely on the nicotine product itself, many brands explore alternative ways to strengthen their identity. Branded merchandise – clothing, accessories, and promotional items featuring the brand’s visual language – is one effective approach.

Through merchandise and considered packaging design, companies can communicate style, values, and design across multiple touchpoints beyond the product. This builds recognition and strengthens relationships with the brand outside traditional packaging.

In this way, brand-building shifts from the product to a broader visual identity. Packaging and merchandise become essential tools for long-term brand positioning – especially in regulated industries where traditional marketing is limited.

At the same time, it’s important to remember that merchandise promoting nicotine products may be subject to the same rules as other forms of advertising.

The rules for labeling and presenting tobacco products are governed by both national legislation and EU regulations, primarily the EU Tobacco Products Directive (2014/40/EU).

The directive sets requirements for health warnings, labeling, and how tobacco products may be displayed on packaging.

February is shaped by Chinese New Year (CNY), one of the most important holidays in the global manufacturing calendar. During this period, many factories close for 3–4 weeks, and production is paused entirely. Even after reopening, ramp-up times can affect capacity and extend lead times. By planning projects well ahead of CNY, you can secure production slots, avoid delays, and ensure smooth timelines and on-time deliveries for the rest of the year.

In the past year, packaging design has been characterized by calm, white and pared down expressions – something that is further reinforced by Pantone’s color of 2026 being Cloud Dancer. At the same time, a clear counter-movement is emerging. More and more brands choose to take up more space, show personality and work with color, strong typography and playful details to stand out.

Together, this forms a new design language where the clean and quiet meets the expressive. A balanced expression where creativity, character and sustainability interact with quality, clarity and a clear purpose. In this trend report, you can read more about the year’s trends 2026 in packaging design.

This Year’s Trend Guide

The biggest trends of 2026 are not just about color and form. They are about feeling. As the fashion world moves toward more expressive and personal statements, packaging design follows suit. This year, the paper bag takes center stage, with more character, more playfulness, and greater design value than ever before.

We see several clear directions:

1. Minimalism remains strong

The Pantone color Cloud Dancer sets the tone for 2026 with a soft, airy white that signals calm, clarity, and optimism for the future. The color reflects an ongoing need for simplicity and balance in a complex world and works as a neutral base that elevates both material choices and form. In packaging design, Cloud Dancer is used to create a clean, considered expression while leaving room for contrast through color, typography, and personal details.

2. Personal design beats polished perfection

Consumers are looking for packaging that feels close, relatable, and human. This means:

  • Subtle colors with depth and texture

  • Surprises in shape, print, or details

3. Sustainability meets aesthetics

Die-cut handles, tactile surfaces, unexpected silhouettes, and paper handles in accent colors show how smart material choices and strong design go hand in hand. As part of our broader sustainability efforts, we have chosen to support CommuniTree – a long-term, third-party-verified project focused on reforestation and sustainable agriculture in Nicaragua.

Part of a wider sustainability commitment

As part of Avisera’s work to develop detailed climate analyses for our products, we also want to make it easier for our customers to support a climate initiative with documented impact.

We contribute to the CommuniTree climate project, which focuses on reforestation and sustainable farming practices in Nicaragua. The project is third-party verified under the Plan Vivo standard and creates both climate benefits and social development for the smallholder families who participate.

What is CommuniTree?

CommuniTree is a climate project in Nicaragua focused on reforestation, agroforestry and land restoration. The project is run by Taking Root (locally BOSNICA) and follows the Plan Vivo standard. According to the project’s public reporting, it has to date:

  • Engaged 4,613 families

  • Planted over 27 million trees

  • Sequestered 4.6 million tonnes of CO₂e

  • Restored 6 out of 6 water sources

  • Paid out over USD 40 million to participating farmers

  • Strengthened women’s entrepreneurship through 801 female farmers

We communicate these figures because they are publicly reported and third-party audited—not to take credit for the results. Our role is to support an existing initiative with documented impact.

A Complementary Climate Initiative

It is important to emphasise that our contribution to CommuniTree does not replace the strategic work of reducing emissions within our own products and processes. On the contrary, we view the project as an added value.

By combining data-driven insight with a verified climate initiative, we aim to make sustainability efforts clearer and more meaningful for the companies that choose to work with us.

When you purchase from us, you indirectly contribute to the continued work of the project through the share of our revenue that goes towards supporting the initiative.

Why climate projects are becoming increasingly important

As sustainability reporting requirements tighten under CSRD/ESRS, companies are expected to demonstrate both how they reduce their emissions and which external climate initiatives they support. This makes it increasingly important to work with verified, long-term projects that create measurable climate and societal benefits.

What does the project mean for you as a customer?
